1 Definitions
- "Company", "we", "our", "us" — AssemblyMan.ca
- "Client", "you", "your" — the individual or entity contracting our services
- "Services" — furniture assembly, installation, wall mounting, home gym setup, and related services provided by AssemblyMan.ca
- "Website" — the website operated at assemblyman.ca
- "Technician" — any employee or representative of AssemblyMan.ca performing Services at your location
2 Booking & Scheduling
Service Requests
All service requests must be submitted by email or SMS/text message only. This ensures a clear written record for both parties and helps avoid misunderstandings about scope, pricing, and scheduling. We do not accept verbal or phone-only bookings.
Booking Confirmation
Your booking is confirmed only after you receive written confirmation from us — by email or SMS/text — with the scheduled date, time, and agreed quote. No booking is considered confirmed until this written confirmation has been provided.
Time Estimates
Estimated timeframes are approximate and may vary based on the complexity, quantity, and on-site conditions of the work.
3 Service Execution
Access
You agree to provide safe and reasonable access to your premises for our technicians at the scheduled time.
Work Area
A clean, adequately lit, and sufficiently spacious work area must be provided. Our technicians may decline to proceed if conditions are deemed unsafe or unsuitable.
Wall Mounting — On-Site Assessment
All wall mounting items — including TVs, shelves, mirrors, artwork, and decorative pieces — are assessed individually on-site by our technician prior to installation. The suitability and safety of any mounting depends on the specific item, its weight and dimensions, the wall type and construction, and the bracket or hardware provided. Our technician will give recommendations on the spot and reserves the right to refuse any installation where, in their professional judgment, a safe and secure result cannot be achieved. No charge will be applied for the assessment in such cases.
Assembly & Installation Instructions
All furniture and installation items should be accompanied by the manufacturer's assembly or installation instructions where available. In rare cases where instructions are missing or incomplete, we may be unable to proceed with the work.
Parts & Components
You are responsible for ensuring all parts, components, and hardware are present and complete before our arrival. Missing parts may result in incomplete work and additional fees for a return visit.
Electrical Supply
For powered equipment — including treadmills, exercise bikes, and other motorized fitness equipment — the client is responsible for ensuring that appropriate electrical supply and any required dedicated circuits are in place before our arrival. AssemblyMan.ca does not perform electrical work.
4 Payment Terms
Rates & Taxes
All quoted prices are exclusive of applicable taxes. HST is charged in addition to the quoted price, as required by the Government of Ontario and the Government of Canada. Taxes are collected by AssemblyMan.ca solely on behalf of the government and are not part of our service fee.
Fixed Price
Your quoted price is your price — no hidden fees or surprise charges. The quoted amount covers the agreed scope of work. Any changes to scope requested after work begins may result in a revised quote prior to proceeding.
Accepted Payment Methods
We accept cash, cheque, and e-transfer.
Payment Timing
Payment is due upon completion of services unless prior arrangements have been made in writing.
Minimum Service Fee
A minimum service fee applies to all bookings as specified on our website.
Additional Charges
Additional charges may apply for:
- Service outside our standard service area
- Complex or unusually time-consuming work not disclosed at the time of booking
- Return visits required due to circumstances outside our control
- After-hours or weekend service where applicable
5 Cancellation & Rescheduling
Cancellation by Client
You may cancel or reschedule with at least 24 hours' notice without penalty. Cancellations with less than 24 hours' notice may incur a fee of 25% of the quoted price.
Cancellation by Company
We reserve the right to cancel or reschedule due to unforeseen circumstances including severe weather, technician illness, or emergencies. We will notify you as promptly as possible.
No-Shows
If you are not present at the confirmed service address at the scheduled time and have not contacted us to reschedule, a no-show fee of 50% of the quoted price may be charged.
6 Workmanship Guarantee
Every job completed by AssemblyMan.ca is backed by our 30-Day Workmanship Guarantee. If any issue arises from our workmanship within 30 days of service completion, we will return and correct it at no additional cost. Full terms, coverage, and exclusions are set out in our Workmanship Guarantee policy, incorporated by reference into these Terms and Conditions.
7 Limitation of Liability
Pre-existing Damage
We are not responsible for any pre-existing damage to furniture, walls, floors, or property. We recommend inspecting all items before our technician begins work.
During Assembly & Installation
While we take all reasonable care, we are not liable for:
- Inherent defects in materials or components
- Manufacturer design flaws
- Damage resulting from strictly following manufacturer assembly instructions
- Wear and tear or damage occurring after service completion
Wall Mounting — Concealed Conditions
Wall mounting work is carried out using professional stud finders, laser levels, and standard drilling practices. AssemblyMan.ca is not liable for damage to concealed wall elements — including hidden pipes, electrical wiring, gas lines, inadequate stud structure, or non-standard construction — that are not detectable using standard professional tools and methods. It is the client's responsibility to disclose any known wall conditions, utility runs, or structural concerns before work begins.
Wall Mounting — All Items & Post-Installation
Every wall mounting job is different. The suitability of any installation depends on the specific item, wall type, and hardware — all of which are assessed on-site before work proceeds. We mount televisions up to 65 inches. Standard cable management behind the TV is included; we do not perform in-wall cable concealment or electrical outlet relocation. Any issues arising from the client's choice of bracket or mounting hardware are the client's responsibility.
Once our technician leaves the premises, AssemblyMan.ca is not liable for damage, injury, or failure of any wall-mounted item resulting from misuse, overloading beyond the item's or bracket's rated capacity, unauthorized modification, or any other action taken after completion. Our 30-Day Workmanship Guarantee covers the quality of our installation work — it does not extend to how items are used or treated after we leave.
Home Gym & Fitness Equipment
All fitness equipment is assembled strictly to manufacturer specifications. AssemblyMan.ca is not liable for injury, damage, or equipment failure resulting from use exceeding manufacturer-rated weight limits, improper use, overloading, unauthorized modification, or lack of maintenance after service completion. The client is responsible for ensuring adequate electrical supply, including dedicated circuits where required, for powered equipment.
Outdoor & Recreation Equipment
For trampolines, basketball hoops, sheds, and outdoor fitness equipment, assembly is performed to manufacturer specifications based on the surface and ground conditions as provided by the client. AssemblyMan.ca is not liable for instability, shifting, or failure resulting from unsuitable, uneven, or soft ground; anchoring limitations beyond the manufacturer's standard hardware; or weather-related deterioration after completion.
Ergonomic & Office Seating
Office chairs and ergonomic seating are assembled to manufacturer specifications. AssemblyMan.ca is not liable for ergonomic outcomes, discomfort, or injury arising from how the client configures, adjusts, or uses the chair after assembly.
Property Damage
In the event of property damage directly caused by our technicians, our liability is limited to the reasonable cost of repair or replacement, whichever is less. Claims must be raised before the technician leaves or in writing within 24 hours of service completion.
Personal Injury
We maintain appropriate liability insurance coverage. Any claims must be reported to us in writing immediately.
Consequential Damages
AssemblyMan.ca is not liable for any indirect, special, incidental, or consequential damages of any kind arising from our services.
8 Customer Responsibilities
Provide accurate information about items, location, and requirements at time of booking.
Inspect all completed work upon completion and report any concerns immediately before we leave.
Verify correct items have been delivered and all parts are present before scheduling.
Confirm you have the necessary permissions to have work performed at the specified location.
9 Reviews & Testimonials
We may offer service discounts or other incentives in exchange for customer reviews. All reviews are entirely voluntary and reflect the honest, independent opinion of the customer. We do not direct, edit, or influence the content of any review in any way.
By submitting a review or testimonial, you grant AssemblyMan.ca the right to display that content on our website and marketing materials, with attribution to your first name and city unless you request otherwise.
10 Photography & Portfolio
Our technicians may photograph completed work for internal quality review and portfolio purposes. Photos are limited to the assembled or installed items and the immediate work area — no individuals or personal belongings are photographed without explicit consent.
If you do not wish your job to be photographed, please advise our technician before work begins. We will respect your preference without any impact on service.
11 Privacy Policy
AssemblyMan.ca is committed to protecting your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy legislation.
What We Collect
When you contact us or book a service, we may collect your name, email address, phone number, service address, and details about the work requested. We collect only what is necessary to provide and communicate about our services.
How We Use It
Your information is used to schedule and deliver services, communicate about your booking, process payment, respond to inquiries, and occasionally follow up for reviews or satisfaction. We do not use your information for unrelated marketing purposes.
We Do Not Sell Your Data
AssemblyMan.ca does not sell, rent, or share your personal information with third parties for commercial or marketing purposes. Your information is used solely to serve you.
Cookies
Our website may use cookies to improve your browsing experience and analyze traffic. You may disable cookies in your browser settings, though this may affect some website functionality.
Your Rights
Under PIPEDA, you have the right to access your personal data, request corrections, and withdraw consent. To exercise any of these rights, or with any privacy-related questions, please contact us at info@assemblyman.ca. You may also file a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated.
12 Intellectual Property
All content on our website — including text, graphics, logos, images, and software — is the property of AssemblyMan.ca and is protected by Canadian copyright law. You may not reproduce, distribute, modify, or create derivative works from any of our content without our express written consent.
13 Force Majeure
AssemblyMan.ca will not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, acts of government, civil unrest, extreme weather, or pandemic. We will notify you promptly and reschedule at the earliest available opportunity.
14 Dispute Resolution
Good Faith Resolution
In the event of any dispute or concern, both parties agree to first attempt resolution in good faith through direct communication. Please contact us at info@assemblyman.ca — we are committed to resolving issues promptly and fairly.
Mediation
If direct communication does not resolve the matter, both parties agree to seek mediation before pursuing any legal action. Any legal proceedings shall be brought exclusively in the courts of the Province of Ontario, Canada.
15 Amendments
We reserve the right to modify these Terms and Conditions at any time. Changes take effect upon posting to our website. The "Last updated" date at the top of this page will be updated accordingly. Continued use of our services following any changes constitutes acceptance of the revised Terms.
16 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
